CREDITORS' RIGHTS AND BANKRUPTCY

In addition, the firm's Bankruptcy department represents a large number of national and regional clients in the consumer automobile finance industry. Our knowledge and experience enable us to effectively and efficiently do the following:
- Represent creditors in matters arising in state and federal court actions and other disputes.
- Assist creditors in chapter and bankruptcy proceedings related to relief from stay, adequate protection, cash collateral proceedings, plan and confirmation issues, asset valuation disputes, reaffirmation agreements, proofs of claim and claim objections.
- Handle all aspects of bankruptcy litigation including non-discharge-ability actions, lien avoidance, preferential and fraudulent transfer disputes and turnover litigation Serve as counsel to bankruptcy trustees and committees of unsecured creditors in the performance of their duties.
- Defend creditors in actions relating to alleged violations of the automatic stay
- Represent clients in bankruptcy transactions including post-petition financing and the planning, structuring and approval process associated with Section 363 asset sales/purchases.
